1Scope

This policy is published by Island Boutique Realty, Inc., a corporation licensed as a real estate brokerage by the State of Hawaii under license RB-22087, at 65-1235 Opelo Road, Suite 6, Kamuela, Hawaii 96743.

It covers this website and the inquiries you send through it, and nothing else. It does not cover information you give a licensee in the course of a transaction, which is governed by the firm's obligations to a client and by Hawaii real estate law. It does not cover a third party you reach from here, including a lender, a title or escrow company, an inspector, or the public agencies behind our resources page, each of which has its own policy.

2What We Collect

What You Send Us

The inquiry form asks for your name, your email address, your telephone number, the licensee you would like to reach if you choose one, and your message, together with your acknowledgment of the box beneath the form. It asks for nothing else, and no other page on this site collects anything from you.

If you write to us by email or telephone us, we hold what you choose to tell us.

What the Server Records

The web server that delivers these pages keeps the ordinary access records that every web server keeps: the address your request came from, the page requested, the date and time, and the browser and operating system reported by your request. These exist to keep the site running, to investigate a fault, and to identify abuse.

To stop the inquiry form being flooded, the application keeps a salted one way hash of the address a request came from, held only in memory and only for a matter of minutes. It cannot be reversed to an address, and it is not a visitor log.

3What We Do Not Collect

We do not use cookies on any public page of this site. There is no analytics package, no advertising or marketing tag, no social media pixel, no session recording and no fingerprinting. We do not build a profile of you and we do not track you across other websites.

No page on this site makes a request to a third party. The typefaces are served from our own server rather than from a font provider, and the map layers are relayed through our own server rather than fetched by your browser, so viewing this site does not announce your visit to anyone else. The only exception is a link you choose to click, which takes you to somebody else's site on their terms.

We never ask for a social security number, a taxpayer identification number, a bank or card number, or a date of birth on this site. Hawaii restricts the collection and display of social security numbers, and there is no reason for a website to hold one. HRS §§ 487J-2, 487J-6 A page or message that appears to ask for any of them in our name is not ours.

We do not ask about, and do not want, your race, color, religion, sex, national origin, familial status, disability, ancestry, age, marital status, sexual orientation, gender identity or expression, or HIV status. It is unlawful to act on any of them in housing, and we will not do so. HRS § 515-3(7)

4How We Use It

We use what you send us to answer you, to arrange a viewing or a conversation, to route your inquiry to the licensee you asked for, and to keep a record of what was asked and what was said.

We do not sell your information, we do not rent it, and we do not trade it. We do not use it for advertising, we do not add you to a mailing list because you sent an inquiry, and we do not disclose it for anyone else's marketing.

5When We Share It

We disclose what you have sent us only to:

  • the licensees and staff of the firm who need it to answer you or to work on your transaction;
  • any supplier the firm needs in order to run its own server or its own mail, such as a network or a backup provider, under contract and only so far as providing that service requires;
  • the other professionals in a transaction you are part of, such as escrow, title, a lender, an inspector or a cooperating brokerage, where sending it is necessary to carry out your instructions; and
  • a court, a regulator or another authority where the law requires it.

The firm is not paid for a referral. It is unlawful for a settlement service provider to give or accept a fee, kickback or thing of value for referring settlement service business. 12 C.F.R. § 1024.14 Where we name a lender, a title or escrow company or an inspector, no money moves for it and you remain free to choose anyone you wish.

6Email, Text and Telephone

We reply to an inquiry by the means you used, or by the means you asked for. Sending us an inquiry is not consent to marketing.

The firm does not send marketing email, does not run a mailing list, and does not run a text messaging service. Anything you receive from us is sent personally by a licensee, and asking that person to stop is enough to stop it. 15 U.S.C. § 7701 et seq.; 47 U.S.C. § 227

7How It Is Protected

The firm takes reasonable measures to protect the information this site collects, consistent with ordinary industry practice, and reviews them as the site changes. Those measures cover how information reaches us, where it is held, and who inside the firm can reach it.

Access to the tools that run this site is restricted to the people who operate it, and each of them has their own credentials.

No system is perfectly secure, and we will not tell you otherwise. If something were to go wrong, what follows sets out what we would do.

8If There Is a Breach

If personal information about you were acquired by an unauthorized person, Hawaii requires us to notify you without unreasonable delay, and to notify the State Office of Consumer Protection and the consumer reporting agencies where more than one thousand people are affected. HRS § 487N-2

We would notify you as soon as we had established what happened and who was affected.

9How Long We Keep It

An inquiry that does not become a transaction is kept only for as long as it is useful to answer you and to show what was said.

A transaction file is kept far longer. Hawaii real estate rules, tax rules and the limitation periods applying to a claim about a transaction all bear on it. HRS §§ 237-41, 237-40(b)

Hawaii has not enacted a comprehensive consumer privacy act, so there is no general deletion right for us to describe. Hawaii does regulate the method of disposal: a record holding personal information must, when disposed of, be shredded, erased or otherwise made unreadable, and we comply with that. HRS § 487R-2

10Your Choices

You may ask us what we hold about you, ask us to correct it, ask us to stop contacting you, or ask us to delete an inquiry that has not become a transaction. Write to Contact@islandboutiquerealty.com and we will act on it, and we will tell you where a retention obligation prevents us from deleting something.

You are not required to give us anything. The inquiry form is the only place this site asks for information, and you may read every page of the site without using it.

Because we set no cookies and perform no cross site tracking, there is nothing on this site for a Do Not Track or Global Privacy Control signal to switch off.

11Automated Decisions

No decision about you is made by an automated system on this site. We do not score inquiries, we do not rank people, and we do not use automated profiling to decide who is answered, which property is shown to whom, or on what terms. What the site does with your inquiry is record it and put it in front of a person. HRS § 515-3

12Where It Is Held

This site and the records behind it are held on servers under the firm's own control in the United States. We do not use an overseas processor for the inquiries this site collects.

13Children

This site is directed to adults transacting in real estate. It is not directed to children, and we do not knowingly collect information from a child under thirteen. If you believe a child has sent us something, write to Contact@islandboutiquerealty.com and we will delete it.

14Visitors from Elsewhere

The firm practices in Hawaii and this site is directed to that market. If you reach it from another state or another country, the information you send is transferred to and held in the United States, where the protections available may differ from those where you live.

We do not sell or share personal information as those terms are used in state privacy statutes. If you believe a law where you live gives you a right in respect of what we hold, write to Contact@islandboutiquerealty.com and we will respond.

15Changes

We may revise this policy. The revised version takes effect when it is posted here, and the date at the head of this page records when it was last revised. Where a change is significant we will say so on this page.
